2.0 Trade Mark and Design Information

As you are aware, Intellectual Property is extremely important to any business and the protection equally so! Below is a brief outline of our Intellectual Property and policy in regards to its application, presentation and violation of its use.

2.2 Registered TradeMark

The word/s Signature Bears® is a registered trademark of Signature Bears Australia Pty Ltd and holds exclusive use of the word Signature Bears® There has been no licence, mortgage or any other agreement, whatsoever to any individual or company to use the name Signature Bear®. Shortened, Abbreviate, or Create Acronyms are also claimed.

3.0 Violation of the Trademark

If you have noticed a product (Calico Bear for writing Upon) using the name Signature Bear® on its products, please contact us using the questions or feedback link below.

3.1 eBay Sellers Notice

Items listed on eBay in violation of our trademark will be reported immediately to eBay, using eBay's VeRo Program, these violation are treated seriously by eBay and could result in the suspension of your eBay account.

Please consider if you are claiming the following in your listing/s

3.1a Replica, Counterfeit Items and Unauthorised Copies

Counterfeits, unauthorised replicas, unauthorised items (such as counterfeit Dvd’s, watches, handbags, or other accessories) or unauthorised copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted on eBay. Unauthorised copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorised copies of media.

Guideline: If the product you are selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it on eBay.

Violations of this policy may result in a range of actions, including:

3.1b Authenticity

Sellers may not disclaim knowledge of, or responsibility for, the authenticity or legality of the items offered in their listings. Sellers should take steps to ensure that their items are authentic before listing them on eBay. If a seller cannot verify the authenticity of an item, the seller is not permitted to list it.

3.1c Misleading Titles

Sellers are not permitted to create titles for their listings that do not accurately describe the item for sale.

3.1d Keyword Spam

Keyword spamming occurs when members place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing.

Violations of this policy may result in a range of actions, including:

* Limits on account privileges
* Account suspension
* Forfeit of eBay fees on cancelled listings
* Loss of PowerSeller status

3.2 Notice to Other Website's

If you have received notice from us, the violation has been electronically recorded into our system and is on file. A 72 hour window is provided to remove the listing before further action WILL be taken!

3.2a Misleading Titles on Web pages

Using our trademark to represent the product you sell or manufacturer is a clear violation of our trademark.

3.2b Search Engine Keyword Spamming

Website's that promoted our name in conjunction with any counterfeit product are in violation of our trademark. Results which include our trademark in conjunction with any URL/s that results in the misrepresentation of our trademark are also in violation.

3.3b Promotional Usages

Website's that promoted our name in conjunction with any counterfeit product is in violation of our trademark.

3.4c Other Online Media Considered as a Violation

Keyword, Item Name, Description, Image Name, File Name, Product Name and Product Packaging.

Please note if you are selling a counterfeit product, or claiming the name "Signature Bear" and or both, you are at risk of pending legal action for infringing the trade mark in which compensation could be pursued.

5.0 Abbreviations

The "word" Signature Bears® includes an abbreviation of, such as Signature Bears, Signature (Other Word or abbreviation) Bear and or Signature Bear® and or any other abbreviation or acronym of that word.
